Terms of Use

These Terms of Use ("Terms") are an agreement between you and Curious Minds LLC, a Delaware limited liability company ("Zibit," "we," "our," or "us"), governing your access to and use of the Zibit website (zibit.app) and the Zibit platform and services (together, the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Your Account

You are responsible for the activity on your account and for keeping your credentials secure. Notify us promptly if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or applicable law.

3. Acceptable Use

You agree not to:

• Use the Services to violate law or infringe others’ rights
• Attempt to reverse-engineer, disrupt, or probe the Services
• Upload malicious code or content
• Send unsolicited commercial email or otherwise misuse any communications feature
• Use the Services to build a competing product by extracting proprietary functionality

4. Your Content

You retain ownership of the content, projects, assets, and prompts you create or upload ("Your Content"). You grant Zibit a limited, worldwide, non-exclusive license to host, process, display, and transmit Your Content solely to operate the Services for you and the users you authorize. You are responsible for having all necessary rights to Your Content.

5. Subscriptions, Billing, and Refunds

Paid plans are billed through our Merchant of Record, Paddle.com Market Ltd., under Paddle’s checkout and invoicing terms. Subscriptions renew automatically until canceled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Refunds are handled per our posted Refund and Cancellation Policy and applicable law. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders.

6. Communications

By creating an account you agree to receive transactional email from Zibit (account verification, password resets, security alerts, billing notices, and event notifications you subscribe to). Marketing email requires your explicit opt-in at signup or in your account settings, and you may unsubscribe at any time.

7. Intellectual Property

The Services, the Zibit name, and the Zibit logo are the property of Curious Minds LLC. No Terms grant you any rights to our trademarks or other intellectual property except as strictly required to use the Services.

8. Third-Party Services

The Services may integrate with or link to third-party services. Your use of third-party services is governed by the terms and privacy policies of those third parties. We are not responsible for third-party services.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL CURIOUS MINDS LLC OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay amounts due, or if required by law. Sections that by their nature should survive termination (e.g., IP, disclaimers, limitation of liability) will do so.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws provisions. The exclusive venue for any dispute arising from these Terms or the Services will be the state and federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via the Services or by email to your account address. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
